I.2. By enrolling in, accessing, or using the Pulse Services, you agree to these Pulse Product Terms (“Pulse Terms”). These Pulse Terms supplement, and are incorporated into, the Terms. In the event of any conflict between these Pulse Terms and the Terms, these Pulse Terms shall prevail solely with respect to your use of the Pulse Services. Capitalized terms not defined in these Pulse Terms shall have the meanings assigned to them in the Terms.
II.1. Pulse Services enable you to access credit scores, credit-related information, and monitoring services that FNBL may make available from time to time through the Platform.
II.2. To use the Pulse Services, you may be required to provide certain personal information requested by FNBL or its service providers from time to time. You agree that all information you provide in connection with the Pulse Services shall be true, accurate, current, and complete.
III.1. In order to use the Pulse Services, you must:
(a) satisfy the eligibility requirements set out in the Terms;
(b) maintain an active Account on the Platform; and
(c) satisfy any additional requirements that FNBL may impose from time to time in connection with the Pulse Services.
III.2. Pulse Services may not be available in all jurisdictions or to all users, and FNBL reserves the right to limit, suspend, or discontinue access to Pulse at any time in its sole discretion to you individually or more generally and in accordance with applicable law.
IV.1. By accepting these Pulse Terms and using the Pulse Services, you understand and agree that you are providing your written instructions, in accordance with the Fair Credit Reporting Act (“FCRA”) and other applicable laws, for FNBL and its service providers to obtain, access, retrieve, use, and retain information about you, including consumer reports, credit scores, credit-related information, and other information from third parties, including consumer reporting agencies, such as TransUnion, Equifax, and Experian.
IV.2. You further authorize FNBL to obtain, access, or retrieve such information on a recurring basis for as long as you maintain an Account, use the Pulse Services, or otherwise use any applicable Ryze Products, subject to applicable law and the Privacy Policy.
IV.3. Any inquiries made by FNBL or its service providers in connection with the Pulse Services will constitute soft pulls and will not negatively affect your credit score. FNBL will not initiate a hard inquiry on your credit file in connection with the Pulse Services without your separate, explicit written authorization.
IV.4. Please note that your credit score shall be updated each time you log in to the Platform, up to a maximum of once per week.
V.1. FNBL may collect, use, process, store, and retain your credit-related information in accordance with these Pulse Terms, the Privacy Policy, and applicable law. This may include:
(a) providing, maintaining, and improving the Pulse Services and other Ryze Products;
(b) presenting personalized offers, recommendations, and communications relating to Ryze Products and services[, but not third-party products or services unless you separately consent to the same];
(c) confirming your identity to avoid fraudulent transactions in your name;
(d) conducting analytics, research, testing, and statistical analysis to improve the Platform, Pulse Services, and other Ryze Products;
(e) legitimate business needs in connection with a transaction initiated by you; and
(f) complying with legal, regulatory, security, and fraud prevention requirements.
V.2. FNBL will not sell, rent, license, or otherwise disclose your individual credit-related information obtained through the Pulse Services to any third party for their own marketing, advertising, credit decisioning, or other independent purposes, unless otherwise disclosed and pursuant to your express consent as required by applicable law. In particular, credit-related information obtained through the Pulse Services will not be used in connection with any credit decision relating to any credit-related Ryze Products, including determinations of your creditworthiness or spending limit, without your separate express consent and notice to you. Your decision to use or discontinue the Pulse Services will have no effect on use of any other Ryze Products.
The foregoing restriction does not apply to: (a) information shared with consumer reporting agencies and their affiliates as necessary to provide the Pulse Services in accordance with their terms; (b) information shared with service providers engaged by FNBL solely to perform services on FNBL’s behalf in connection with the Pulse Services, who are contractually prohibited from using your information for any other purpose; (c) disclosures required by applicable law, court order, or regulatory request; or (d) disclosures to which you have given your separate express prior consent.
VI.1. You have certain rights under the FCRA with respect to information held in your credit profile, including, but not limited to:
(a) the right to know if information in your credit profile has been used against you in connection with any credit, employment, or other decision. If you are denied credit or receive less favorable terms based on information in a consumer report, you are entitled to an adverse action notice identifying the consumer reporting agency that provided the report and their contact information;
(b) the right to access your credit file from consumer reporting agencies at www.annualcreditreport.com in certain circumstances;
(c) the right to dispute inaccurate or incomplete information in your credit report with both the relevant consumer reporting agency and the furnisher of the information;
(d) the right to have inaccurate, incomplete, or unverifiable information corrected or removed from your credit report;
(e) the right to place a fraud alert or security freeze on your credit file in certain circumstances; and
(f) the right to seek damages from violators of the FCRA.
VI.2. If you believe that any information in your credit report is inaccurate or incomplete, you may dispute it directly with the applicable consumer reporting agency or with the furnisher of the information to such agency. FNBL does not furnish information to consumer reporting agencies in connection with the Pulse Services and does not have authority to correct information held in your credit file with any consumer reporting agency. FNBL may act as a furnisher in connection with other Ryze Products that you may use, such as the Booster Card.

VII.1. The credit scores, credit-related information, and other information made available through the Pulse Services are provided solely for informational and educational purposes.
VII.2. FNBL does not guarantee:
(a) any improvement in your credit score;
(b) approval for any financial service;
(c) the accuracy, completeness, or availability of any credit-related information; or
(d) that any actions taken by you based on information made available through the Pulse Services will result in any particular credit outcome.
VII.3. You agree and acknowledge that your credit score and credit profile may change over time based on numerous factors that are outside FNBL’s control.
VIII.1. FNBL does not undertake any obligation to actively monitor your credit score for fraud, identity theft, unauthorized activity, or any other changes or activity relating to your credit profile. The Pulse Services are designed to enable you to independently monitor your credit information.

FNBL is a federally regulated bank and is not acting as a financial, investment, tax, or legal advisor when providing the Pulse Services. The Pulse Services are designed to provide you with access to your credit information for monitoring and informational purposes only. Through the Pulse Services, FNBL does not provide credit repair services, will not dispute information in your credit file on your behalf, and will not make representations about improving your credit score.
VIII.4. Nothing in these Pulse Terms shall be construed to limit any rights you may have under federal consumer financial protection laws, including the Fair Credit Reporting Act, the Equal Credit Opportunity Act, the Gramm-Leach-Bliley Act, or other applicable federal or state laws. If any provision of these Pulse Terms conflicts with applicable law, the applicable law shall prevail.
