Provided Pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN), 15 U.S.C. § 7001 et seq.
Effective Date: September 1, 2026 | Version 1.0
Before you open a Vault account or apply for a Booster Card or use the Pulse service through the Bank’s website or app, you must affirmatively consent to receive records, disclosures, and communications electronically. This is required because all Bank Products (as defined below) are delivered exclusively through electronic channels. Your consent is voluntary, but if you do not consent, you will not be able to open or use any Bank Product.
This consent is legally separate from all other account agreements and disclosures and must be given before you receive or sign any other document.
As used in this E-SIGN Consent, “Bank Product” means any financial product or service offered through the Bank’s website, app and program, currently including: (a) the Booster Credit Card, a credit-building charge card issued by The First National Bank of Lacon (the “Bank”); (b) the Vault Deposit Account, a demand deposit account established at the Bank, and associated Vault Debit Card issued by the Bank; and (c) the Pulse service, a credit score monitoring service operated by the Bank. “Bank Product” also includes any additional product or service that Bank may make available to you in the future through the Bank’s website or app, provided that Bank notifies you of any material new product or service at the time it is made available to you.
By giving your consent below, you agree that the Bank may provide the following records, disclosures, and communications to you in electronic form only, in lieu of paper:
This consent applies to all Bank Products you open or use now or in the future. If you later add a new Bank Product (for example, if you open a Vault account after first using a Booster card, or use the Pulse service at any time), this consent automatically extends to cover all disclosures and communications required in connection with that additional Bank Product. You will not be required to provide a new E-SIGN consent when adding a Bank Product.
Records Not Covered by this E-Sign Consent. Certain records and notices are excluded from the scope of E-SIGN by law (15 U.S.C. § 7003) and are therefore not governed by your consent provided hereunder. These include, for example, notices of default, acceleration, repossession, foreclosure, or eviction relating to a primary residence; notice of cancellation or termination of utility services; certain notices required to accompany the transportation or handling of hazardous or dangerous materials; and any other categories excepted under Section 7003. We will provide any such notices in the manner required by applicable law, which may be in paper form.
Debt Collection Communications (Booster). If your Booster card becomes past due, is charged off, or is otherwise subject to collection activity, communications relating to the collection of that debt are governed by the Fair Debt Collection Practices Act and Regulation F (12 C.F.R. Part 1006), and by any separate electronic-communications consent, notice, or opt-out required under those rules, rather than by this E-Sign Consent. Your consent to electronic delivery under this E-Sign Consent is not, by itself, consent to receive debt-collection communications electronically, and any electronic delivery of such communications will be handled in accordance with the applicable requirements and any separate consent obtained at that time.
To access and retain electronic records provided to you in connection with the Bank Product and related account(s), you will need the following:
| Device | A computer, smartphone, or tablet capable of connecting to the internet. |
| Internet Connection | A working internet connection. |
| Web Browser or Mobile OS | A current, supported version of a major web browser (such as Chrome, Safari, Firefox, or Edge) or a current mobile operating system (iOS or Android) capable of displaying web content. |
| An email address that you actively monitor, capable of receiving messages from the Bank | |
| PDF Reader | Software capable of opening and displaying PDF documents, such as Adobe Acrobat Reader (free) or equivalent. |
| Storage | Sufficient local storage to save or print documents for your records, or access to a printer. |
Your responsibility to maintain access. You are responsible for ensuring that your device and software continue to meet these requirements for as long as you hold and use any Bank Product. If your hardware or software changes and you can no longer access electronic records, you must notify us as described in Section 5.
We will deliver electronic records to you through one or more of the following methods:
When delivery is complete. A record is considered delivered to you when the Bank, as applicable, makes it available electronically—whether by sending it to your email address, making it available in the Bank app, or posting it to a designated portal—even if you do not open, download, or review it. It is your responsibility to keep your email address current and to monitor communications from the Bank.
Email address accuracy. The email address you provide at account opening is the address we will use for all electronic communications. You must notify us promptly if your email address changes. You can update your email address through the Bank’s app or by contacting us using the information in Section 7.
You have the right to receive a paper copy of any electronic record provided to you. To request a paper copy of a specific disclosure or document, contact us using the information in Section 7. We will provide a paper copy at no charge.
Paper copies of periodic statements. You also have the right to receive your periodic account statements in paper form. To request paper statements on an ongoing basis, contact us using the information in Section 7. A fee of $5 per statement may apply for paper statements; see the Fee Schedule for details.
Requesting paper does not withdraw your consent. Requesting a paper copy of a specific document, or requesting paper statements, does not constitute a withdrawal of your consent to electronic delivery for other documents. To withdraw your consent entirely, see Section 5.
You have the right to withdraw your consent to electronic delivery at any time. To withdraw your consent, contact us using the information in Section 7 and clearly state that you are withdrawing your consent to electronic delivery.
Important: Consequence of Withdrawing Consent.
All Bank Products are delivered exclusively through electronic channels. Because we cannot practicably provide all required regulatory disclosures and account communications in paper form, withdrawal of your consent to electronic delivery may result in the closure of all Bank Products you hold.
If you withdraw your consent and the Bank closes any deposit or credit account, the Bank, as applicable, will return any remaining balance to you by ACH transfer or other Bank-approved method within a reasonable time.
For a joint account and its related enrollment process, each account holder consents individually and separately to this E-Sign Consent and may independently and separately withdraw consent in accordance its terms. Again, you acknowledge that your withdrawal of consent to this E-Sign Consent will result in closure of all of your account.
Effect of withdrawal on prior records. Withdrawal of your consent does not affect the legal validity of any electronic records delivered to you before the date of withdrawal.
You are responsible for keeping your email address and other contact information current throughout your account relationship. If your email address or contact information changes, you must update it promptly through the Bank website, app or by contacting us using the information in Section 7.
If electronic communications are returned as undeliverable or we are unable to reach you electronically, we may treat this as a change in circumstances that affects your ability to receive electronic records. We may attempt to contact you using other contact information on file and may suspend the electronic delivery of records until your contact information is confirmed. Failure to maintain current contact information may result in your not receiving required regulatory disclosures.
To request paper copies, withdraw your consent, update your contact information, or ask questions about this consent, contact us at:
