This Consent to Contact (this “Consent”) is provided by you to First National Bank of Lacon, a national banking association organized under the laws of the United States, with its principal place of business at 11 Broad Street, Lacon, Illinois 61540 (together with its affiliates, subsidiaries, agents, contractors, service providers, successors, and assigns, collectively, “FNBL,” “we,” “us,” or “our”). FNBL’s Privacy Policy is incorporated into and forms part of this Consent by reference.
I.1. By submitting information to us, you agree that you have provided your explicit permission and consent authorizing us to contact you at any telephone number, email address, or mailing address that you provide to us or from which you contact us, subject to your privacy preferences and to the extent permitted by applicable law. You expressly authorize FNBL to contact you for the following purposes (collectively, the “Purposes”):
(a) marketing, promotional, and advertising communications regarding FNBL’s products, services, events, or offerings;
(b) follow-up communications related to prior inquiries, applications, transactions, or interactions;
(c) informational communications, including surveys, customer satisfaction inquiries, research requests, and other non-transactional notifications;
(d) account servicing, transactional notifications, and other communications reasonably related to your relationship with FNBL;
(e) debt collection and account recovery communications, to the extent permitted by applicable law (you may also receive text messages or calls related to fraud or security alerts independent of your other communication preferences); and
(f) such other purposes as may be specified in FNBL’s Privacy Policy, available at Privacy Policy .
I.2. FNBL’s collection, use, storage, and disclosure of your personal information, including the contact information you provide hereunder, is governed by FNBL’s Privacy Policy, available at Privacy Policy. By providing this Consent, you acknowledge that you have had the opportunity to review FNBL’s Privacy Policy and that you understand how your personal information will be handled in connection with the communications described herein.
II.1. You consent to be contacted through any of the following methods, to the extent permitted by applicable law:
(a) telephone calls, including calls placed using an automatic telephone dialing system (“ATDS”) or other automated dialing equipment, any system capable of storing and dialing telephone numbers, and calls using artificial or prerecorded voice messages, as well as live agent calls, to any telephone number (including wireless and residential numbers) that you provide (automated messages may be played when the telephone is answered, whether by you or another person, and messages may be left on voicemail or answering machines);
(b) short message service (“SMS”) text messages and multimedia messaging service (“MMS”) messages, including messages sent using an automatic telephone dialing system or other automated technology, to any mobile telephone number that you provide;
(c) electronic mail (email);
(d) postal mail; and
(e) other methods, including push notifications, in-app messaging, and other communications channels.
II.2. You acknowledge that message and data rates may apply to telephone calls and text messages and that your telecommunications carrier’s standard rates and charges will apply. The frequency of text messages and calls varies depending on the nature and purpose of the communications. Neither FNBL nor your wireless carrier is liable for delayed or undelivered messages.
III.1. You may withdraw your consent to receive voice calls and text messages, including marketing, promotional, and other non-transactional communications, at any time by any reasonable means, including by:
(a) replying “STOP,” “UNSUBSCRIBE,” or “OPT OUT” to any text message received from FNBL;
(b) clicking the “unsubscribe” or similar link contained in any marketing email (if an email does not include opt-out instructions, it is a transactional or relationship message, and you cannot opt out of receiving such messages); or
(c) sending written notice to FNBL at support@ryze.money.
III.2. The foregoing methods are illustrative and not exclusive. FNBL may not designate an exclusive means for you to revoke consent. You may revoke consent using any reasonable method that clearly expresses your desire not to receive further calls or text messages, including by voicemail, email, or verbal request to a live agent.
III.3. FNBL will honor your withdrawal request within a reasonable time, not to exceed ten (10) business days following receipt of your request.
III.4. FNBL may send a single confirmatory message acknowledging your opt-out request; such confirmation will not contain any marketing or promotional content. Withdrawal of consent to marketing or promotional communications will not affect your receipt of transactional, servicing, account-related, or legally required communications from FNBL and will not apply to communications that you separately and subsequently request.
IV.1. All communications made pursuant to this Consent shall be made in compliance with applicable law, including the Telephone Consumer Protection Act, the CAN-SPAM Act, the Gramm-Leach-Bliley Act, and applicable state telecommunications, telemarketing, and privacy laws.
IV.2. Nothing in this Consent shall be construed to authorize any communication that is prohibited by applicable law. FNBL reserves the right to monitor or record telephone calls for quality assurance, training, and security purposes, to the extent permitted by applicable law.
IV.3. All telephone calls and text messages made pursuant to this Consent will identify FNBL or the party calling or texting on FNBL’s behalf. You may receive a call announcing that the call is from, or is being made on behalf of, FNBL before any prerecorded message is delivered.
IV.4. FNBL reserves the right to change the content, format, or delivery frequency of any text message, email, or other communication, including the right to discontinue such communications in their entirety, at any time and without prior notice to you, subject to applicable law.
By providing contact information on the Platform, you certify and represent that: (a) you are the subscriber to, or the regular user of, each telephone number provided; (b) the telephone number(s), email address(es), and postal address(es) provided are accurate and currently assigned to you or under your control; and (c) you will promptly notify FNBL if any telephone number that you have provided changes, is reassigned, is deactivated, or is no longer under your control.
VI.1. If your mobile telephone is switched off, out of range, or otherwise subject to carrier or device conditions that affect delivery, you may not receive messages, or messages may be delayed. FNBL does not guarantee continuous, uninterrupted, or secure messaging services and cannot guarantee that text messages sent through your wireless carrier will be delivered to you.
VI.2. You acknowledge that text messages and emails sent to you may be transmitted without encryption and may include information about your application or your FNBL account.
VI.3. The information contained in text messages and emails is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, FNBL shall not be responsible for any loss or damage that may result from the interception or misuse of any information by unauthorized third parties or from undelivered text messages or emails, provided that FNBL has implemented reasonable security measures consistent with applicable law and industry standards.
VII.1. FNBL reserves the right to amend, modify, or supplement the terms and conditions of this Consent upon reasonable prior written notice to you (which may be provided by email, text message, or posting on FNBL’s website). Any material expansion of the scope of communications or methods of contact authorized under this Consent requires your affirmative re-consent. Your continued consent to receive communications from FNBL following any non-material amendment shall constitute your acceptance of such changes.
By clicking “I Agree,” “Submit,” or similar button, you confirm that you have read, understood, and agree to the terms of this Consent. Your electronic signature or submission constitutes your prior express written consent for purposes of the Telephone Consumer Protection Act and applicable regulations. FNBL will maintain a record of this Consent, including the date, time, and manner in which it was obtained.
